1. Acceptance of Terms

By downloading, accessing, or using the PetSpot mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

You must be at least 16 years old to use the App. If you are under 16, you may not use PetSpot, and we will delete any account we learn belongs to someone under 16 along with its data.

2. Use License

We grant you a limited, non-exclusive, non-transferable license to download and use the App on your personal devices for personal, non-commercial purposes only. You may not:

  • Reverse engineer, decompile, or attempt to extract the source code
  • Rent, lease, or lend the App
  • Modify or create derivative works based on the App
  • Use the App for any commercial or illegal purpose
  • Circumvent any security or technical protection measures

3. User Responsibilities

You agree to:

  • Provide accurate and truthful information when creating an account
  • Maintain the confidentiality of your login credentials
  • Not impersonate other users or provide false information
  • Comply with all applicable laws and regulations
  • Respect the privacy and rights of others, including wildlife

4. Prohibited Content

You may not post, upload, or share content that:

  • Sexualises or exploits a minor in any way, including child sexual abuse material. This is banned absolutely, is reported to the authorities, and results in immediate and permanent termination — see our Child Safety Standards
  • Depicts cruelty, abuse, or illegal harm to animals
  • Is hateful, defamatory, obscene, or sexually explicit
  • Infringes on intellectual property rights or copyrights
  • Contains malware, viruses, or harmful code
  • Is false, misleading, or fraudulent
  • Violates privacy laws or others' privacy rights

5. Intellectual Property Rights

5.1 Our IP

PetSpot, including its logo, design, software, and trademarks, is owned by PetSpot Inc. All rights are reserved.

5.2 Your Content

You retain all rights to photos and captions you post ("User Content"). By posting content on PetSpot, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Display your content on the App and website
  • Create derivative works for identification and analysis purposes
  • Use your content for improving wildlife identification features
  • Share anonymized, aggregated data with research partners

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • PetSpot is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • Our total liability is limited to the amount you paid for the App (if any)
  • We are not responsible for third-party content or services

7. Assumption of Risk

The App provides wildlife sighting information and location data. You assume all risk associated with wildlife interaction. PetSpot does not recommend approaching, handling, or feeding wild animals. Always follow local wildlife laws and safety guidelines.

8. Termination

We may terminate or suspend your account at any time, with or without cause, and without notice if we determine you have violated these Terms or engaged in prohibited conduct.

9. Governing Law

These Terms are governed by the laws of [Your Jurisdiction], and you agree to submit to the exclusive jurisdiction of its courts.

10. Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve disputes by contacting us at support@getpetspot.com.

11. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and PetSpot regarding the App and supersede all prior agreements.

12. Modification of Terms

We may update these Terms from time to time. Continued use of the App after such updates constitutes your acceptance of the modified Terms.
